The Transatlantic Mirror Let me tell you about two Americas. In the US, lawyers and firms face no barriers in marketing their services. They advertise on billboards, television, and social media. Firms publish thought leadership, celebrate victories, and showcase expertise openly. Some of those ads are cringe-worthy. Ambulance-chasing personal injury lawyers with 1-800 numbers and dramatized accident re-enactments. Maybe Rule 36 has a point. Now, here’s the other America: Ruth Bader Ginsburg worked at firms that advertised. Bryan Stevenson’s Equal Justice Initiative markets its work extensively. Top-tier lawyers command premium fees, maintain fierce commitments to justice and equity, and yet market themselves ethically. Dignity and visibility, it turns out, aren’t mutually exclusive. So if commercializing legal work truly tarnishes its nobility, should we not instead, reconsider what dignity actually means? The uncomfortable truth about Rule 36 in India is that it claims to ‘level the playing field’, but it actually just tilts it. It creates an information asymmetry where: • Clients struggle to find qualified lawyers • Qualified lawyers struggle to be found • Established firms with inherited networks thrive • Talented newcomers remain invisible Is our resistance to legal marketing actually about ethics, or about preserving gatekeeping power? Over the next few posts, I’ll be exploring how AI is quietly transforming legal practice in India; and not by breaking rules, but by transcending paradigms. How firms are building visibility without violating ethics in fascinating and innovative new ways. And most importantly, whether these rules designed to protect professional dignity are actually protecting professional hierarchy instead. I say this as someone who has spent years memorizing those rules (so if this feels like mild treason, you’re welcome). I’m convinced that Indian lawyers find themselves in a peculiar prison. Bars made not of iron, but of ethical ambiguity that increasingly resembles institutional inertia. Our current system calls this “protecting professional dignity.” But there’s a change around the corner, and I’m beginning to wonder if it protects something else entirely?
